Concrete Quality SLU (VAT ID: ESB87365334), with registered address in Madrid, Spain, represented by Juan Manuel Pereira (the “Controller”, “we”, “us”, or “Concrete Quality”), is responsible for the processing of your personal data as described in this Privacy Policy.

2. Personal Data We Collect
Concrete Quality is a software platform for the construction industry focused on materials testing, quality control, and production data. We collect minimal personal data, limited to what is necessary to provide our services.
2.1 Data You Provide
– Email address: Required to create an account and access the services. This may be any valid email address and does not need to identify you personally.
– Name: You may voluntarily provide your name within the application. This data is entered by you and is not verified against any identity document.
– Company name, country, and position: Optional fields you may choose to complete. This data is not verified.
– Billing information: If you subscribe to paid services, we may collect company name, VAT number, and billing address for invoicing purposes. Payments are processed via bank transfer; we do not collect or store credit card or payment card data.
2.2 Data Collected Automatically
– IP address: Collected for logged-in users for security and service provision purposes.
– Usage data: Non-personally-identifying information such as browser type, language preference, and the date and time of requests.
– Cookies: We use cookies to identify and track visitors, their usage of our website, and access preferences. You may configure your browser to refuse cookies, though certain features may not function properly without them.
– Error reports: The application may automatically send error reports containing the user identifier, date and time, operating system information, and error description. No additional personal data is included.
2.3 Data We Do NOT Collect
We do not collect or process: gender, age, income, health data, biometric data, political opinions, religious beliefs, trade union membership, genetic or biometric data, or any other special category of personal data as defined in Article 9 of the GDPR. The focus of our software is industrial production data, not personal data.
3. Legal Basis for Processing
We process your personal data on the following legal bases under Article 6(1) of the GDPR:
– Performance of a contract (Art. 6(1)(b)): Processing your email address and account data is necessary to provide you with access to the Concrete Quality services under our Terms of Service.
– Legitimate interest (Art. 6(1)(f)): We process usage data and anonymized statistics to improve our products and services. These statistics are based on aggregated software usage data and business data, not on your personal information. Our legitimate interest does not override your fundamental rights and freedoms given the minimal nature of the data processed.
– Legal obligation (Art. 6(1)(c)): We may retain certain data (e.g., billing records) to comply with applicable tax and accounting regulations.
4. Purposes of Processing
We process your personal data for the following purposes:
– Providing and maintaining access to the Concrete Quality platform and associated services.
– Communicating with you regarding your account, service updates, and support requests.
– Generating invoices and managing billing.
– Improving our products through anonymous, aggregated usage statistics.
– Ensuring the security and integrity of our systems.
– Complying with legal obligations.
5. Data Sharing and Sub-Processors
We do not sell, rent, or trade your personal data to any third party. We share personal data only with the following categories of recipients, and only to the extent necessary:

5.2 Legal Disclosures
We may disclose your personal data if required to do so by law, or in response to a valid request by a court, regulatory authority, or government body, or when we believe in good faith that disclosure is necessary to protect the property or rights of Concrete Quality, third parties, or the public at large.
6. International Data Transfers
Our primary servers are located in Germany (EU), operated by OVH SAS. Our email service provider Brevo is headquartered in France (EU). For these sub-processors, no transfer of personal data outside the European Economic Area (EEA) occurs.
Google Analytics, used only on our informational website (not in the application), may process data in the United States. Google LLC is certified under the EU-US Data Privacy Framework (DPF), which provides an adequate level of protection as recognized by the European Commission.
We do not otherwise transfer personal data outside the EEA. Should this change, we will implement appropriate safeguards such as Standard Contractual Clauses (SCCs) approved by the European Commission.
7. Data Retention
We retain your personal data for as long as your account remains active and for a reasonable period thereafter. Specifically:
– Account data (email, name, profile): Retained for the duration of your account. Upon termination or deletion request, we will delete or anonymize this data from our active systems within one (1) month of confirming the request, except where retention is required by law.
– Backup copies: Our systems maintain regular automated backups for disaster recovery and business continuity purposes. Personal data deleted from active systems may persist in backup copies for a maximum of 6 months, after which it is overwritten through the normal backup rotation cycle. During this period, backup data is not actively used and is protected by the same security measures as active data. Backups are not restored selectively; they exist solely for catastrophic recovery scenarios.
– Billing records: Retained for the period required by applicable tax and accounting regulations (currently 6 years under Spanish law).
– Usage data and logs: Retained in aggregated, anonymized form for product improvement purposes. Individual log entries are purged within 12 months.
– Email correspondence: We retain support and business emails for our records to ensure continuity of service.
8. Your Rights
Under the GDPR, you have the following rights regarding your personal data. You may exercise these rights at any time by contacting us at contact@concrete-quality.com:
– Right of access (Art. 15): You have the right to obtain confirmation as to whether we process your personal data and to request a copy of that data.
– Right to rectification (Art. 16): You have the right to request correction of inaccurate personal data. You can also update most of your data directly within the application.
– Right to erasure (Art. 17): You have the right to request deletion of your personal data, subject to legal retention obligations. Deletion from active systems will be completed within one (1) month of confirming the request. Data in backup systems will be removed through the normal backup rotation cycle (maximum 6 months).
– Right to restriction of processing (Art. 18): You have the right to request that we limit the processing of your data in certain circumstances.
– Right to data portability (Art. 20): You have the right to receive your personal data in a structured, commonly used, and machine-readable format.
– Right to object (Art. 21): You have the right to object to processing based on legitimate interest. We will cease processing unless we demonstrate compelling legitimate grounds.
– Right to lodge a complaint: You have the right to lodge a complaint with the Spanish Data Protection Authority (Agencia Espanola de Proteccion de Datos, AEPD) at www.aepd.es, or with any other competent supervisory authority in the EU.
We will respond to any request within one month of receipt. This period may be extended by two further months where necessary, taking into account the complexity and number of requests.
9. Data Security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include:
– Encryption of data in transit (TLS/HTTPS).
– Access controls and authentication for all system users.
– Regular backups of application databases.
– Logical separation of client data within the application.
A detailed description of our technical and organizational measures is available in our Data Processing Agreement (DPA), which can be provided upon request.
10. Data Breach Notification
In the event of a personal data breach that is likely to result in a risk to the rights and freedoms of individuals, we will notify the competent supervisory authority (AEPD) within 72 hours of becoming aware of the breach, as required by Article 33 of the GDPR. Where the breach is likely to result in a high risk to your rights and freedoms, we will also notify you directly without undue delay.
11. Cookies
Our website uses cookies for the following purposes:
– Essential cookies: Required for the operation of the website and application (session management, authentication).
– Analytics cookies: Used on our informational website only (not in the application) via Google Analytics to understand how visitors use the site. These cookies collect anonymized data.
You may configure your browser to refuse all or certain cookies. If you disable essential cookies, some features of our services may not function properly.
12. Business Transfers
If Concrete Quality, or substantially all of its assets, were acquired, or in the unlikely event that Concrete Quality ceases operations, user information would be one of the assets transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer may continue to use your personal data as set forth in this Privacy Policy. We will notify you of any such transfer and of any changes to the applicable privacy terms.
13. Age Requirement
Our services are designed for professional and business use in the construction industry. We do not knowingly collect personal data from individuals under the age of 18. If you are under 18, please do not use our services or provide any personal data.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify registered users of material changes by email or through the application. Your continued use of our services after any modification constitutes acceptance of the updated Privacy Policy. We encourage you to review this page periodically.

1. Introduction and Scope
These Terms of Service (the “Agreement”) govern all use of the websites, software applications, and services provided by Concrete Quality SLU (VAT ID: ESB87365334), represented by Juan Manuel Pereira, hereinafter referred to as “Concrete Quality”, “we”, “us”, or “our”.
Our products and services include:
– The concrete-quality.com website and associated informational websites.
– The “Quality Control” software application and its server-based services.
– The “Quality Mix” software application and its server-based services.
– Localized and specialized subscriptions (e.g., regional packages, data transfer, live support).
– Any future applications, features, or services released under the Concrete Quality brand.
(collectively, the “Services”).
By accessing or using any part of the Services, you agree to be bound by this Agreement. If you do not agree, you may not access or use the Services. The Services are intended for professional and business use in the construction industry. Users must be at least 18 years of age.
2. Your Account
If you create an account to use the Services, you are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must immediately notify Concrete Quality of any unauthorized use of your account or any other breach of security. Concrete Quality will not be liable for any loss or damage arising from your failure to protect your account credentials.
3. Software License
3.1 Grant of License
Subject to the terms of this Agreement, Concrete Quality grants you a non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes.
3.2 Free and Paid Services
Certain features of the Services are provided free of charge (“Free Services”). Additional features and server-based services are available as paid subscriptions (“Paid Services”). The scope and pricing of Paid Services are as indicated in the application at the time of subscription.
3.3 Restrictions
You may not:
– Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software component, except to the extent expressly permitted by applicable law.
– Inspect source code, compiled libraries, database schemas, or other proprietary information using reverse-engineering tools.
– Modify, adapt, translate, or create derivative works based on the Services.
– Sublicense, resell, or distribute the Services or any part thereof, unless explicitly authorized by Concrete Quality.
– Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
3.4 Distribution
The desktop applications may be freely reproduced and distributed within your organization provided that each copy is complete and unmodified, includes all copyright and trademark notices, and is accompanied by a reference to this Agreement. You may not include the software in any commercial product or package without explicit written authorization from Concrete Quality.
4. Payment and Billing
4.1 Subscriptions
Paid Services are billed on a prepaid basis for the applicable subscription period. By subscribing, you agree to pay the fees indicated at the time of subscription. Subscription fees are non-refundable except as required by applicable law.
4.2 Automatic Renewal
Unless you notify us before the end of the current subscription period that you wish to cancel, your subscription will automatically renew for an equivalent period. You may cancel at any time through the subscription management section of the application.
4.3 Pricing Updates
Prices are subject to change with 30 days’ written notice prior to the invoicing date. Changes may reflect: exchange rate variations greater than 10% for invoicing in currencies other than Euros, yearly adjustments for inflation (reference index: Spanish CPI / IPC), and general improvements in our systems and services. You may terminate your subscription without penalty within 30 days of receiving notice of a price change.
4.4 Electronic Billing
By subscribing to Paid Services, you accept electronic billing. Invoices are accessible and printable within the application. No paper invoices will be sent unless specifically requested and agreed.
5. Intellectual Property
5.1 Ownership
All intellectual property rights in the Services, including but not limited to software, websites, designs, text, graphics, logos, images, audio, video, and documentation, are owned by Concrete Quality or its licensors. This Agreement does not transfer any intellectual property rights to you.
5.2 Trademarks
“Concrete Quality”, the Concrete Quality logo, and all related names, marks, and logos are trademarks of Concrete Quality. You may not use these marks without prior written permission.
5.3 Copyright
All content provided through the Services is protected by copyright laws and international treaty provisions. You may use the Services to create your own data and reports, which remain your property. However, the underlying software, algorithms, and systems remain the exclusive property of Concrete Quality.
5.4 Your Content
You retain ownership of any data, content, or materials you create or upload to the Services (“Your Content”). By using the Services, you grant Concrete Quality a limited, non-exclusive license to store and process Your Content solely to provide the Services. Concrete Quality will not access, use, or share Your Content for any other purpose without your explicit consent.
5.5 Copyright Infringement
Concrete Quality respects intellectual property rights. If you believe that material on our platform infringes your copyright, please notify us at contact@concrete-quality.com. We will investigate and take appropriate action, including removing infringing material where confirmed.
6. User-Generated Content
If you post content on our blogs, forums, or community features, you are responsible for ensuring that such content does not infringe third-party rights, contain malicious code, violate any law, or constitute spam or misleading material. Concrete Quality reserves the right to remove any content that violates this Agreement or is otherwise harmful, at its sole discretion.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. CONCRETE QUALITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
All calculations, recommendations, warnings, and results provided by the Services are to be considered as guidance only, not as a commitment by Concrete Quality to achieve said results. The responsibility for testing and validating results before use in production lies entirely with the user. Concrete Quality is not liable for any concrete or products produced based on information from the Services.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONCRETE QUALITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR COST OF PROCUREMENT OF SUBSTITUTE SERVICES.
Our total aggregate liability under this Agreement shall not exceed the fees paid by you to Concrete Quality during the six (6) months immediately preceding the event giving rise to the claim.
Concrete Quality shall not be liable for any data loss resulting from software updates, upgrades, or plugin installations. You are responsible for maintaining backup copies of your data.
9. Indemnification
You agree to indemnify and hold harmless Concrete Quality, its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services or your violation of this Agreement.
10. Termination
Either party may terminate this Agreement at any time. Concrete Quality may suspend or terminate your access to the Services immediately if you breach any term of this Agreement. Upon termination, you must cease all use of the Services. Provisions that by their nature should survive termination shall remain in effect, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
Upon termination, you may request a copy of Your Content (including your data stored in the application) within 30 days. After this period, we will delete Your Content from active systems within one (1) month. Data may persist in backup systems for up to 6 months through the normal backup rotation cycle.
11. Modifications to this Agreement
Concrete Quality reserves the right to modify this Agreement at any time. We will notify you of material changes by email or through the application at least 30 days before they take effect. Your continued use of the Services after the effective date of any modification constitutes acceptance of the updated Agreement.
12. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Spain. Any disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain.
The parties agree to attempt to resolve any dispute amicably before initiating legal proceedings. If a dispute cannot be resolved within 30 days of written notice, either party may submit the matter to the courts of Madrid.
13. General Provisions
This Agreement constitutes the entire agreement between you and Concrete Quality regarding the Services. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Concrete Quality’s failure to enforce any right or provision shall not constitute a waiver of such right or provision.
You may not assign your rights under this Agreement without our prior written consent. Concrete Quality may assign its rights without restriction.

Concrete Quality’s products and services—including hardware, devices, images, videos, sounds, music, texts, documents, websites, and software both downloadable or accessible via web (the “content”) — are owned either by Concrete Quality, SLU (VAT ID: ESB87365334), represented by Juan Manuel Pereira, from now on referred to as “Concrete Quality”, or by third parties who have granted Concrete Quality permission to use the content. Concrete Quality cannot grant you permission for content that is owned by third parties. You may only copy, modify, distribute, display, license, or sell the content if you are granted explicit permission within the Terms of Service that accompany the content or are provided in the website.
Concrete Quality ® is not associated with Microsoft Corporation, and does not act as a representative for any of its products like .NET Framework, SQL Server, Office (Excel, Word, Powerpoint, etc.). All mention to these products and brands are for informative purposes only.
